1) CONTRACT
The contract is between Shakespeare Holidays Ltd and the lead guest. Any issues arising under the contract should be addressed to Shakespeare Holidays Ltd. The contract will be entered into when Shakespeare Holidays Ltd issues the confirmation form and will be subject to all booking conditions. The guest should check the confirmation form carefully.
2) PAYMENT
A minimum deposit of 30% of the rental fee is payable if the booking is made more than 8 weeks before the start of the rental. The balance will be split into two further payments with the final payment due 8 weeks before the commencement of the rental. Non-payment of the balance of the booking on or before the due date shall be construed as a cancellation of the contract by the guest and the deposit will be forfeited. For bookings made less than 8 weeks before the commencement of the rental, the total price is payable. All payments should be made via the payment link provided specific to your booking.
3) CANCELLATION
Any cancellation made by the guest for whatever reason should be in writing and addressed to Shakespeare Holidays Ltd to the email address info@shakespeareholidays.co.uk. . It should be noted that upon payment of your initial deposit, you are from that point forward liable for the full balance, whether you take the rental or not. In an attempt to help the situation, upon receipt of notice of cancellation for bookings where the full payment has already been made, Shakespeare Holidays will seek to re-let the property for the period of the booking. If Shakespeare Holidays Ltd succeeds in re-letting the property for the whole period at the same rental price we will refund all the monies paid less an administrative charge of £200 per booking. If Shakespeare Holidays Ltd only succeeds in re-letting the property for part of the period booked or for a lower price it shall refund an amount equal to the money paid less (a) the rental for the period which is not re-let (b) any difference in the price originally paid and the price we have subsequently let it for and (c) an administrative charge of £200. If Shakespeare Holidays Ltd is unable to re-let the property at all then all monies paid by the Client shall be forfeit to Shakespeare Holidays Ltd to cover the price of the lost booking.
For bookings where only the deposit has been paid, the above procedure still applies and we will attempt to re-let the dates. Again, if we are successful in renting the full booking period at the same price paid, we will refund your deposit less £200 administrative charge. Any shortfall between the price you have paid as a deposit and the total price of the booking will be payable on the day the rental was due to commence to cover the cost of the booking.
In the case of any unforeseen circumstances or adverse weather conditions, Shakespeare Holidays will not reimburse any monies paid under any circumstances. We will happily provide a receipt that can be submitted to your relevant insurance company for their consideration.
4) CHANGE OF DATE
Shakespeare Holidays Ltd may consider a request from a guest to change the dates of the booking after confirmation has been issued, but please bear in mind that changes cannot be guaranteed and are at the discretion of Shakespeare Holidays Ltd. Agreement will be considered subject to all the following conditions being met.
- The request is received more than 16 weeks away from the start date.
- Availability of the alternative date.
- If a price difference occurs either way all monies must be paid in full by the obligatory party.
- The guest pays an administrative fee of £200.
- In the event that the stay is within 16 weeks from the start date we will not consider any requests for change of date under any circumstances.
5) PERIOD OF HIRE
Rentals commence, unless otherwise notified or agreed, at 3.00pm on the day of arrival and terminate at 9.30am on the day of departure.
6) RIGHT OF ENTRY
Shakespeare Holidays Ltd shall be allowed right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.
7) BREAKAGES OR DAMAGES
The Client is legally bound to reimburse Shakespeare Holidays Ltd for replacement, repair or extra cleaning costs on demand.
8) CARE OF THE PROPERTY
The Client shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects etc, in the property or surrounding communal areas of the property and to leave them in the same clean and tidy condition as well as in the same state of repair and condition, at the end of the rental period as at the beginning.
9) USE OF PROPERTY
The number of persons occupying a property must not exceed the number stipulated on the booking form. The property will be used for personal and domestic purposes only. The property shall not be used for commercial purposes. Shakespeare Holiday Cottages reserves the right to refuse entry to the entire party if these conditions are not observed.
10) USE OF HOT TUBS
Where a guest rents a property including a hot tub, Shakespeare Holidays Ltd will email along with the arrival information, a document with full operating instructions and ‘Do’s & Don’ts’ relating to the use of the hot tub. By using the hot tub you agree that you understand this document and agree to abide by these rules on behalf of you as the lead guest and any guests within your group. Shakespeare Holidays Ltd employs the services of a fully trained water care specialist to maintenance and look after the water treatment on the hot tubs on a frequent basis along with independent laboratory tests to confirm that the water care is correct. Shakespeare Holidays Ltd will not be liable for any injury caused by misuse of the hot tubs or any adverse reactions caused by the chemicals used to treat the hot tubs. Any damage cause to the hot tubs by a guests actions will be payable on demand.
11) NATURAL OCCURENCES
Whilst we will try to help with any natural occurrences where permissible and possible. We cannot be held responsible or liable for circumstances beyond our control. Examples of such are bees, insects, rodents, weather, war or any natural disasters. We will always try to resolve the situation (other than protected species), however these circumstances are outside our control.
12) COMPLAINTS
Should there be any cause for complaint during the occupation of the property, it must be notified promptly to Shakespeare Holidays Ltd and in case of serious problems confirmed in writing. Any complaints after the rental will not be entertained.
13) PETS
No Pets permitted (except for registered guide dogs and support dogs belonging to those with visual and hearing impairments are allowed in all properties. Clients with allergies should be aware that we cannot guarantee that a registered guide and/or support dog has not stayed in their chosen property, nor can we accept any liability for any suffering which may occur as a result of such animals having been present).
14) CCTV
Some of our properties have outdoor CCTV cameras. This is not a monitored system and recorded footage is only viewed if there is an incident reported by a guest or the prep team. This footage is automatically recorded over by new footage approximately every five days and no footage is kept past this point.
15) LIABILITY
Shakespeare Holidays Ltd (for itself or its employees) shall not be liable to the guest or third parties for any accident, damage or loss, injury expense or inconvenience, which may be suffered, incurred, arise out of or in any way connected with the rental. No term of the Contract is enforceable under the Contracts (Rights of The Third Parties Act 1999) by a person who is not a party to the contract. If the property which the guest has booked becomes unavailable or unusable for some reason prior to the date of a booking then Shakespeare Holidays Ltd obligation will be to (a) Use their best endeavour to find a suitable alternative property, or failing which (b) to reimburse the guest for any monies paid to Shakespeare Holidays Ltd. Shakespeare Holidays Ltd will not be liable for any monies paid to other parties.
16) VEHICLES & CONTENTS
Shakespeare Holiday Ltd is not responsible for any damage or loss suffered from vehicles or their contents at any of the properties. Guests should be vigilant and not leave valuables or belongings in their vehicles.
17) ELECTRIC VEHICLE CHARGING
It is not permitted to charge your electric vehicles at out properties using plug sockets. It is not covered under our insurance, can cause danger by overloading the system especially where there are also hot tubs and is very expensive for us especially in the current energy crisis. Anybody that is found to be charging their electric vehicle will be subject to a charge of £50.
18) WARRANTIES
Shakespeare Holiday Ltd aims to ensure that the information provided is accurately conveyed in brochures and other promotional literature or material produced. However, the information may have changed by the time of your booking. Whilst every effort is made to ensure the accuracy of the information at the time of printing, changes and errors occasionally occur. Therefore, you must check all details and arrangements of your property at time of booking. Shakespeare Holidays Ltd does not warrant and is not responsible for the accuracy of any verbal information given or statements made by its employees.
19) YOUR RIGHTS
Your statutory rights are not affected by anything contained within these Terms & Conditions. The Contract is subject to English Law and any disputes will be dealt with by the Courts of England and Wales only, unless you live in Scotland or Northern Ireland, in which case proceedings may be brought in the Courts of those countries.
